okay, here is my rant.
Lewis told his boss - lets call him "Mr X", that he was moving to Palmerston, and that he would give him plenty of notice once he knew when etc. Mr X was a bit miffed. a week later Suckface starts asking the staff about lewis and what he has been doing at work(Mr X is very rarely actully there). Anyway on saturday Lew works at local football clubrooms from 6-12. He had been into the bar at 2 and worked from 2-5, then 6-12. he went back to the bar at 12:30 and usually if they are busy, he pitched in until they settle down and then he goes home. He waled in and the bar was dead so he said, "see you, I'm off home" Mr X had a huge go at him about not performing properly and how it was his job to stay there - blah blah blah. So lew told his boss to stick it...well, actually he didn't - he used slightly different language - hey this is a family show right! Lew was so angry as Mr X has dicked him around so much - scheduling him to work at 10am, when he had worked until 4am the next day and tellinghim to "harden up" when he complained...forgetting to pay us and having to return a LOT of groceries as the card was declined...
anyway, sunday dawned and lewis was annoyed all day. that night he said he had a meeting on Monday about this.
monday comes and Mr X announces at the meeting that he has heard Lewis is stealing. Lewis is like WHAT???? he was "stealing" free pool games. - what actually happened was that several customers were complainging about the service, so he gave them some pool games to try and make them happier. he explained this and Mr X said that no, it was stealing and that Lew was suspended. he was stunned,
Anyway came home and I did some investigating and realised that by law you can't be suspended without pay and that we have a good case for unfair dismissal. but Lewis is so annoyed he doesn't want to pursue it. Anyway, rings a mate and gets another job. Goes into meeting on Thursday and was officially fired. So the new job starts on wednesday...well, until last night when the guy rang up and said unbeknown to him the other owner had already hired his cousin - so no job!!!!!!
rang winz this morning and they said that it looks like he will have to pursue unfair dismissla and have a thirteen week stand-down period. luckily I still get money from IRD and we have our moving money, but what a fricken mess. lew does not want to go for unfair dismissal - he wants to just move on. Personally, if it were me I'd be out for every cent i could as revenge.

Oh no. I think you are going to have to tell hubby to fight this one. Not for the revenge part but for his own reputation as well. How will it look to others that he didnt fight it back ect. Plus all the money you guys will lose out on.

Argh Liz that sucks! I agree with Shirena tho - tell that Lewis to forget his stubborn pride and take the B*stard to the cleaners!

yup, go for unfiar dismissal - it is always on the employees side, so he is very likely to get some $$$ out of the sucky boss. what an arse! i would be all vengence vengence vengence if that happened to us! (well actually, no i would be crapping my pants with worry about money etc etc, but you know what i mean)

he was really angry about me "pressuring him" to do unfair dismissal, so have decided to leave everything, until the meeting with winz - am hoping that if they say "do it or no money" then he will have to, and i get away with not being in the bad books.
AND MIL is in the shed cleaning it out and I've discovered that all the kids summer toys weren't put away properyly by FIL and are now distributed throughtou the whole bloody place, so have to go on a mission to find everything, and hope it hasn't been chucked already.

Oooo that is so frustrating! It's almost like Mr X has been looking for a way to let Lewis go without paying him, looking for faults etc etc. Have you any rights about the other job he was accepted for and then turned down on?

That suxs big time. Hope theres an 'happy' ending for you guys, what ever you decide to do. IMO - i would take him for unfair dismissal as there is a process you are s'pose to follow when firing someone - warnings, written warnings etc... Did your DH have a contract? It would be in there.

Oh that sux hard out. I totally agree with the others in the fact that pride needs to take second place oppose to the need for the MOney to survive. Mr X needs a wake up call too and be taught that you cant go around treating staff like that. Goodluck to you guys. Arghhh about the toys FIL didnt put away properly.

sounds like Mr X was following what happened at the subway dissmisal...ummm didnt he hear that subway LOST....go him!!!! tell DH to go talk to someone - employment lawyer etc...think you still have 90 days to file but check out what he needs to do...been long time since i did that kind of stuff....

looked at everything already but thanks everyone. If we do end up going that route I am practically an employment lawyer now (who needs 4 years of uni huh???)
am thinking and lloking on the bright side - as in, have a rather large inheritence coming through in about three weeks, so that should help - just hope no-one has contested the will - and that it doesn't get delayed by anything.

You have 90 days of the event within which to file a personal grievance. Basically, even if he has been fired, he is still entitled to pay up to the termination plus any holiday pay owing. Definitely go and speak to a solicitor. He may claim that theft is serious misconduct and therefore immediate dismissal is justified, but he will have to prove the theft. This is purely from an employment law view (from what I know).
He sounds like an ar** who is trying to get away with with. Good luck, definitely give it a go for unfair dismissal!

done and done. lewis is related to like...all of Gisborne so that will help. Inheritence is now coming in Septemnber so a bit bummed I'll end up missing King Lear - BUT can still see the ballet perhaps...or maybe dad will treat me (he should! he's getting 100grand from the inheritence!)should probably refrain from sharing personal info...

I can understand your condition very well. There are such types of work (or such a boss) that no amount of money can compensate for your nerves. But I can say that there are other ways. I found an alternative for myself - https://www.ua-football.com/en/betting I chose sports betting because I really love football. We often go to the local soccer team games with my dad. I just went a little further and began to benefit from my hobby. Do you have a hobby that you can monetize?
